2. OBJECT AND SCOPE OF APPLICATION

The present Conditions regulate the access to the contents and the services and products offered by HWK through its Web Site, as well as the use of the same by the Users. However, HWK reserves the right to modify the presentation, configuration and content of the Website, as well as the conditions required for its access and/or use. Notwithstanding the foregoing, access to certain content and the use of certain products or services may be subject to certain special conditions, which, depending on the case, will replace, complete and/or modify these Terms of Use and, in case of contradiction, the terms of the special conditions will prevail over these general conditions. Before using, booking and/or contracting such specific products or services offered by HWK, the User must carefully read the specific conditions created for this purpose by HWK. The use, reservation and/or contracting of said specific products or services implies the acceptance of the particular conditions that regulate them in the version published by HWK, at the time of said use, reservation and/or contracting. The access, navigation and use of the Web Site entail and imply the acceptance by the User of this Legal Notice and the Conditions of Use included in it. 

In this sense, User shall be understood as the person who accesses, browses, uses or participates in the services and activities, free or onerous, developed on the Website.

3. ACCESS

Access to the contents and use of the services provided by https://hwk.es/ is free of charge, although some of the services and contents offered by HWK to third parties through the Website may be subject to prior contracting and payment of an amount, which will be specified in their own contracting conditions. Access to the Website by minors under 14 years of age is prohibited, unless they have the prior and express authorization of their parents, guardians or legal representatives, who will be held responsible for the acts carried out by the minors in their care, in accordance with current regulations. In any case, it will be presumed that the access made by a minor to the Website has been made with the prior and express authorization of their parents, guardians or legal representatives. Access and navigation through the Web Site does not require registration.

4. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

This Website is governed by Spanish law and by national and international legislation on intellectual and industrial property. Under no circumstances shall it be understood that the User's access to and browsing of the Website or the use, acquisition and/or contracting of products or services offered through the Website implies a waiver, transmission, license or total or partial transfer of said rights by HWK. The User has a strictly private right of use, exclusively for the purpose of enjoying the benefits of the service in accordance with these Terms of Use. References to names and commercial or registered trademarks, logos or other distinctive signs, whether owned by HWK or by third parties, imply a prohibition on their use without the consent of HWK or their legitimate owners. At no time, unless expressly stated, access to or use of the Website and/or its contents and/or services, confers on the User any right over the trademarks, logos and/or distinctive signs included therein protected by Law. All Intellectual and Industrial Property rights over the contents and/or services are reserved and, in particular, it is forbidden to modify, copy, reproduce, publicly communicate, transform or distribute in any way all or part of the contents and/or service included in the Website for public or commercial purposes, without the prior, express and written authorization of HWK or, where appropriate, of the owner of the corresponding rights.

5. USE OF THE SITE

The User undertakes to make proper use of the Website in accordance with the Law and this Legal Notice. The User will be liable to HWK or third parties for any damages that may be caused as a result of the breach of this obligation.

It is expressly forbidden to use the Website for purposes harmful to property or interests of HWK or third parties or in any other way overload, damage or disable the networks, servers and other computer equipment (hardware) or products and computer applications (software) of HWK or third parties.

The User agrees to use the contents in accordance with the Law and this Legal Notice, as well as with any other particular conditions that may be applicable in accordance with the provisions of clause 2. 

By way of example, the User, in accordance with current legislation, must abstain from:

1. Reproduce, copy, distribute, make available, publicly communicate, transform or modify the contents except in cases authorized by law or expressly consented to by HWK or by whoever holds the ownership of the exploitation rights in its case.

Reproduce or copy for private use the contents that may be considered as software or database in accordance with the current legislation on intellectual property, as well as its public communication or making it available to third parties when these acts necessarily imply the reproduction by the User or a third party.
   
   
3. Extract and/or reuse all or a substantial part of the contents of the Website as well as the databases that HWK makes available to the Users.

6. RESPONSIBILITIES AND GUARANTEES

• OF INFORMATION

HWK will make reasonable efforts to verify and update the information and materials included in the Website and to assess the reliability of its sources. Notwithstanding the foregoing, the information published on or through the Website is provided for informational purposes only and is for guidance purposes only, and HWK does not guarantee or warrant that its content is accurate, complete, precise, timely, reliable or updated when it is not its own information, and disclaims any liability for such information.

HWK declares that it shall not be liable, nor its directors or employees, for investment decisions made using the information contained in the Website. The User is aware that he/she is responsible for his/her own investment decisions and that he/she must seek his/her own professional advice as to the suitability of his/her investment decisions. 

• OF THE QUALITY OF SERVICE

Access to the Website does not imply any obligation on the part of HWK to control the absence of viruses, worms or any other harmful computer element. It is up to the User, in any case, the availability of adequate tools for the detection and disinfection of harmful computer programs.

HWK is not responsible for any damage caused to the computer equipment of Users or third parties during the provision of the Website service.

• OF SERVICE AVAILABILITY

Access to the Website requires services and supplies from third parties, including transportation through telecommunications networks, whose reliability, quality, continuity, and operation are not the responsibility of HWK. Consequently, the services provided through the Website may be suspended, cancelled, or become inaccessible, either prior to or during the provision of the Website service. 

HWK shall not be held liable for any damages or losses incurred by the User resulting form failures or disconnections in telecommunications networks that lead to the suspension, cancellation, or interruption of the Website service, either during its provision or beforehand.

7. LINKS TO OTHER WEB PAGES

If on the Website the User could find links to other web pages through different buttons, links, banners, etc., these would be managed by third parties. Consequently, HWK cannot assume any type of responsibility for any aspect related to the web page to which a link could be established from the Website, specifically, but not limited to, its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its contents, in general. In this sense, if Users have effective knowledge of the illegality of activities carried out through these third-party web pages, they must immediately notify HWK so that the access link to it can be disabled. The establishment of any type of link from the Website to another third-party website will not imply that there is any type of relationship, collaboration or dependency between HWK and the person responsible for the third-party website.

8. PRIVACY POLICY

To use certain content and services, HWK may require certain personal data from Users. In these cases, HWK will inform Users in advance and adequately, so that they can give their explicit consent to the processing of their data by HWK, for the specific purpose processed. In these cases, the requested data is considered essential and, if it is not provided, it will not be possible to access the use of said content and services. The data will be used only for the purposes detailed in the data collection forms. In any case, HWK guarantees the adoption of security measures aimed at guaranteeing the confidentiality of personal data provided by Users.

9. DURATION AND MODIFICATION

HWK may modify the terms and conditions stipulated herein, in whole or in part, by publishing any changes in the same way as this Legal Notice appears or through any type of communication addressed to Users. The duration of this Legal Notice therefore coincides with the time of its display, until they are modified in whole or in part, at which time the new modified Legal Notice will become effective.

Likewise, HWK may terminate, suspend or interrupt, at any time, without prior notice, access to the contents of the website, without the User being able to demand any compensation.

10. GENERALITIES

The headings of the different clauses are for information purposes only and will not affect, qualify or expand the interpretation of the Legal Notice. In the event that any provision or provisions of this Legal Notice were considered null or inapplicable, in whole or in part, by any competent Court, Tribunal or administrative body, such nullity or inapplicability will not affect the other provisions of the Legal Notice. The non-exercise or execution by HWK of any right or provision contained in this Legal Notice will not constitute a waiver thereof, unless acknowledged and agreed to in writing by it.

11. APPLICABLE LEGISLATION AND JURISDICTION

The relations established between HWK and the User shall be governed by the provisions of current Spanish regulations. HWK and the User, expressly waiving any other jurisdiction that may apply to them, shall submit any disputes and/or litigation to the Courts and Tribunals of the city of Madrid.
